Nabors on marrying partner: 'Just wanted it legal'

(AP) ? Actor Jim Nabors says marrying his longtime male partner doesn't change anything about their relationship ? he just wanted it to be formally acknowledged.

"I just wanted it legal," the 82-year-old actor best known as Gomer Pyle in "The Andy Griffith Show" told The Associated Press on Wednesday.

Nabors married 64-year-old Stan Cadwallader in Seattle on Jan. 15. Nabors says they have been partners for 38 years.

Nabors said they flew from Honolulu just for the short ceremony and were married in a hotel room by a judge friend who drove up from Olympia, Wash.

Nabors said he's not an activist but feels strongly that gay marriage should be a right for everyone.

"I think every person on this earth has a choice of who they want to spend their life with," he said.

News of Nabors' marriage was first reported by Hawaii News Now. Nabors told Hawaii News Now he's been open about being gay with co-workers and friends but hadn't acknowledged it to the media before. He said he's not ashamed of people knowing, he just didn't tell people because it was "such a personal thing."

The couple met in 1975 when Cadwallader was a Honolulu firefighter.

Nabors told the AP that Cadwallader began working for him long ago and took care of his business affairs.

"He's my best friend," Nabors said.

Nabors became an instant success when he joined "The Andy Griffith Show" in spring 1963. The character of Gomer Pyle ? the unworldly, lovable gas pumper who would exclaim "Gollllll-ly!" ? proved so popular that in 1964 CBS starred him in "Gomer Pyle, U.S.M.C."

In the spinoff, which lasted five seasons, Gomer left his hometown of Mayberry to become a Marine recruit. His innocence confounded his sergeant, the irascible Frank Sutton.

Gay marriage became legal in Washington state last month. Several other states allow it, but Nabors said he picked Washington because he didn't want to travel too far from his Hawaii home.

"I like the weather," he said. "Still, I froze my butt off there."

Over party lines: The plan for immigration

WASHINGTON (AP) ? A bipartisan group of leading senators has reached agreement on the principles of sweeping legislation to rewrite the nation's immigration laws.

The deal, which was to be announced at a news conference Monday afternoon, covers border security, guest workers and employer verification, as well as a path to citizenship for the 11 million illegal immigrants already in this country.

Although thorny details remain to be negotiated and success is far from certain, the development heralds the start of what could be the most significant effort in years toward overhauling the nation's inefficient patchwork of immigration laws.

President Barack Obama also is committed to enacting comprehensive immigration legislation and will travel to Nevada on Tuesday to lay out his vision, which is expected to overlap in important ways with the Senate effort.

The eight senators expected to endorse the new principles Monday are Democrats Charles Schumer of New York, Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado; and Republicans John McCain of Arizona, Lindsey Graham of South Carolina, Marco Rubio of Florida and Jeff Flake of Arizona.

Several of these lawmakers have worked for years on the issue. McCain collaborated with the late Democratic Sen. Edward M. Kennedy on comprehensive immigration legislation pushed by then-President George W. Bush in 2007, only to see it collapse in the Senate when it couldn't get enough GOP support.

Now, with some Republicans chastened by the November elections which demonstrated the importance of Latino voters and their increasing commitment to Democrats, some in the GOP say this time will be different.

"What's changed, honestly, is that there is a new, I think, appreciation on both sides of the aisle ? including maybe more importantly on the Republican side of the aisle ? that we have to enact a comprehensive immigration reform bill," McCain said Sunday on ABC's "This Week."

"I think the time is right," McCain said.

The group claims a notable newcomer in Rubio, a potential 2016 presidential candidate whose conservative bona fides may help smooth the way for support among conservatives wary of anything that smacks of amnesty. In an opinion piece published Sunday in the Las Vegas Review-Journal, Rubio wrote that the existing system amounts to "de facto amnesty," and he called for "commonsense reform."

According to documents obtained by The Associated Press, the senators will call for accomplishing four goals:

?Creating a path to citizenship for illegal immigrants already here, contingent upon securing the border and better tracking of people here on visas.

?Reforming the legal immigration system, including awarding green cards to immigrants who obtain advanced degrees in science, math, technology or engineering from an American university.

?Creating an effective employment verification system to ensure that employers do not hire illegal immigrants.

?Allowing more low-skill workers into the country and allowing employers to hire immigrants if they can demonstrate they couldn't recruit a U.S. citizen; and establishing an agricultural worker program.

The principles being released Monday are outlined on just over four pages, leaving plenty of details left to fill in. What the senators do call for is similar to Obama's goals and some past efforts by Democrats and Republicans, since there's wide agreement in identifying problems with the current immigration system. The most difficult disagreement is likely to arise over how to accomplish the path to citizenship.

In order to satisfy the concerns of Rubio and other Republicans, the senators are calling for the completion of steps on border security and oversight of those here on visas before taking major steps forward on the path to citizenship.

Even then, those here illegally would have to qualify for a "probationary legal status" that would allow them to live and work here ? but not qualify for federal benefits ? before being able to apply for permanent residency. Once they are allowed to apply they would do so behind everyone else already in line for a green card within the current immigration system.

That could be a highly cumbersome process, but how to make it more workable is being left to future negotiations. The senators envision a more streamlined process toward citizenship for immigrants brought here as children by their parents, and for agricultural workers.

The debate will play out at the start of Obama's second term, as he aims to spend the political capital afforded him by his re-election victory on an issue that has eluded past presidents and stymied him during his first term despite his promises to the Latino community to act.

"As the president has made clear for some time, immigration reform is an important priority and he is pleased that progress is being made with bipartisan support," a White House spokesman, Clark Stevens, said in a statement. "At the same time, he will not be satisfied until there is meaningful reform and he will continue to urge Congress to act until that is achieved."

For Republicans, the November elections were a stark schooling on the importance of Latino voters, who voted for Obama over Republican Mitt Romney 71 percent to 27 percent, helping ensure Obama's victory. That led some Republican leaders to conclude that supporting immigration reform with a path to citizenship has become a political imperative.

Hey, alien hunters: NASA's alien planet archive is open for business

"The entire world can help us" find exoplanets (alien planets), says a Kepler scientist. NASA is throwing open its list of possible exoplanets to anyone who wants to look.

Scientists with NASA's planet-hunting Kepler spacecraft have revamped the mission's online archive of alien worlds, opening up the database for the entire world to see.

Researchers are now posting all exoplanet sightings by the Kepler observatory into a single, comprehensive website called the "NASA Exoplanet Archive." Instead of going through the long planet confirmation process before making data publicly available, since December of last year, scientists have started shoveling out all the data Kepler collects into a comprehensive list.

"When we make that list, right away it goes to the archive," Kepler mission team member Steve Howell told SPACE.com during the 221st American Astronomical Society meeting in Long Beach, Calif., this month. "So the day we know about the list, the archive knows about the list. And then everybody, including us, can work on that list. But that list is dynamic so if we, or a community person, makes an observation and says, 'Hey, I looked at this planet candidate but it's really an eclipsing binary,' then that entry in the archive will be changed."

The archive has information about the size, orbital period and other metrics of any possible planet discovered and investigated by Kepler.

"It's all in real time," Howell said. "The sausage-making process is exposed."

Before the new archive was debuted, astronomers were already doing creative work with the data. One created a visually stunning video of every known Kepler planet candidate ? 2,299 unconfirmed exoplanets at the time ? orbiting one central point.

The Kepler team?s new "open" attitude toward data release is giving everybody, not just members of the scientific community, a chance to do some hands-on scientific research by building their own experiments, Howell said.

A group of high school students has already taken data from groups of planets observed by Kepler and mapped them against a map of known stars looking for a pattern. Howell doesn?t think they'll see much, but he's glad that they have the opportunity to get creative.

"The entire world can help us with this Kepler data," Howell said. "I don't see any downside."

?Planet Hunters, a collective of amateur astronomers, recently found 42 new alien planets using Kepler data that was publicly available prior to the launch of the new archive system.

It would be difficult for Kepler scientists to get their jobs done without the help of amateur astronomers around the globe, mission researchers said. By making the exoplanet archive more accessible, it could mean that more planets are found and confirmed in shorter amounts of time than ever before.

More people sifting through the wealth of data collected by Kepler means that scientists have a better chance of finding even more planets circling distant stars, Howell added.

Since its launch in 2009, NASA's Kepler spacecraft has flagged more than 2,300 objects as possible alien worlds. Although only about 100 have been confirmed, scientists expect that at least 80 percent could be certifiable exoplanets.

Currently, Kepler has entered a "safe mode" after researchers spotted an issue with one of the spacecraft's three reaction wheels that are responsible for orienting the telescope. The malfunction has stalled science observations, but researchers hope that the issue will be resolved by Sunday (Jan. 27).

SAN DIEGO ? Torrey Pines may be Tiger Woods? territory, but he hasn?t won here since 2008. His performance for much of Sunday at the Farmers Insurance Open was reminiscent of his play during those simpler years.

Woods shot 69 to take a four-shot lead into the final round, which will begin later Sunday and be completed Monday. He was six strokes ahead until he reached the par-5 18th, which he bogeyed after finding a bunker off the tee and with his third shot. Brad Fritsch, a 35-year-old rookie off the Web.com Tour, is Woods? closest pursuer. He birdied No. 18 to reach 10 under par. Fritsch is trying to extend this streak: a 2012 Web.com Tour graduate has finished first or second in each of the season's first two full-field events.

Woods was victorious the last time he played on a Monday at Torrey Pines. That was in the 2008 U.S. Open, where he needed 19 holes to dispatch of Rocco Mediate.

This is Woods' largest 54-hole lead since the 2009 BMW Championship. Of course, he?s only held the third-round lead once since then as he?s gone through his personal crisis and a prolonged rebuilding process.

He missed just two fairways on the front nine Sunday, often twirling his driver as another ball found the fairway. He missed just three greens, as well. Four of Woods? five birdies came on putts of 3 feet or less. The other was completed by a 6-foot putt.

If Woods hangs on, it will be his eighth PGA Tour victory at Torrey Pines. He?s won the Farmers Insurance Open six times, as well as that 2008 U.S. Open. He?s won a major in five of the six seasons during which he won the Farmers Insurance Open. Of course, those victories came during some of his most successful seasons. No one knows what this season holds for Woods, but he?s off to a good start in his PGA Tour debut.

Researchers identify new target for rheumatoid arthritis

Researchers at Hospital for Special Surgery have identified a potential new target for drugs to treat patients with rheumatoid arthritis (RA), a protein known as IRHOM2. The finding could provide an effective and potentially less toxic alternative therapy to tumor necrosis factor-alpha blockers (TNF-blockers), the mainstay of treatment for rheumatoid arthritis, and could help patients who do not respond to this treatment. Efforts to develop drugs that hone in on this new target are underway.

"This study is an elegant example of the capacity of basic science cell biologists to work with translational rheumatologists to address a clinically relevant question at a basic level," said Jane Salmon, M.D., Collette Kean Research Chair and co-director, Mary Kirkland Center for Lupus Research at Hospital for Special Surgery (HSS) in New York City, and an author of the study. "We have identified a clinically relevant target that can be applied to patients in the near term." The study will appear online, ahead of print, on January 25, in the Journal of Clinical Investigation and in the February 2013 print issue.

Rheumatoid arthritis, an autoimmune disease, is triggered, in large part, by TNF-alpha, a small signaling protein usually involved in launching protective systemic inflammatory responses. With excessive TNF production, however, immune cells can become activated inappropriately and cause tissue inflammation. This produces a number of diseases, including RA. While TNF-blockers help many RA patients, these treatments are very expensive, and some patients do not respond. For this reason, researchers have been searching for alternative targets in patients with inflammatory diseases against which drugs can be directed.

"TNF can be thought of as a balloon tethered to the surface of cells. To work, it must be cut loose by signaling scissors called TACE (TNF-alpha converting enzyme)," said Carl Blobel, M.D., Ph.D., program director of the Arthritis and Tissue Degeneration Program at HSS. While blocking TACE could be another way to treat rheumatoid arthritis, researchers know this strategy would likely have side effects since patients lacking TACE are prone to skin infections and intestinal lesions.

Earlier this year, HSS investigators demonstrated that the TACE scissors are regulated by molecules called IRHOM1 and IRHOM2, which are thought to wrap around TACE and help it mature into functional scissors. They also demonstrated that mice that are genetically engineered to lack IRHOM2 lack functional TACE on the surface of their immune cells and don't release TNF. Surprisingly, these mice are healthy, and do not develop skin or intestinal defects.

In the current study, HSS researchers set out to investigate why this paradox exists. After examining tissues of IRHOM2-deficient mice, they found that IRHOM2 regulates TACE on immune cells, whereas IRHOM1 is responsible for helping TACE mature elsewhere in the body, such as in brain, heart, kidney, liver, lung and spleen cells. "IRHOM2 appears to have a more restrictive and exclusive function in immune cells," said Dr. Blobel.

The researchers then set out to determine whether blocking IRHOM2 could be a strategy to treat RA. They used a mouse model that mimics human rheumatoid arthritis in mice genetically engineered to be deficient in IRHOM2. They found that these rodents did not develop inflammatory arthritis and were otherwise healthy.

"When we tested mice that don't have IRHOM2 in a model for inflammatory arthritis, we found they were protected and they were protected as well as mice that didn't have any TNF," said Dr. Blobel. "Because TNF is the driver of rheumatoid arthritis in human disease, as evidenced by how well anti-TNF drugs work, we feel that this provides a completely new angle on blocking TNF release. It would be wonderful to be able to inactivate TACE in a tissue-specific manner and IRHOM2 provides a unique mechanism for us to do so."

Using drugs that inactivate IRHOM2 in humans, clinicians will be able to block the function of TACE only in immune cells. "We can prevent the deleterious contribution of TACE to rheumatoid arthritis patients and preserve its protective function in skin and intestines," said Dr. Blobel. "With IRHOM2, we have a unique and unprecedented opportunity to inactive TACE only in certain cell types, and not in others, and there is currently no other effective way of doing that."

The researchers say the next step is to identify antibodies or pharmacological compounds that can be used to block the function of IRHOM2 and are safe in patients. These HSS investigators are currently working to identify and test such agents. "In theory, IRHOM2-targeted drugs will have less toxicity than TNF alpha blockers," said Dr. Salmon. "They block TNF release only from specific cells, those known to contribute to joint inflammation and damage."

(AP) ? With a team flag waving from an open window of their chartered plane, the San Francisco 49ers arrived at their first Super Bowl in 18 years on Sunday.

The players walked off the airplane in a businesslike manner ? no video recorders or cameras, no waves to onlookers. Quarterback Colin Kaepernick, wearing a red wool cap sporting "49ers" on it, mouthed the words to a song on his head phones as he calmly walked on the tarmac.

Most of the team's veteran players disembarked first, including center Jonathan Goodwin, who won a Super Bowl three years ago with the Saints.

The 49ers will play Baltimore next Sunday, seeking their sixth Super Bowl crown but first since the 1994 season. The Ravens arrive Monday.

(AP) ? The death toll from rioting in the Egyptian city of Port Said has risen to 31, health officials said Sunday, as army troops backed by tanks and armored vehicles staked out positions at key government facilities to try to restore order.

The violence erupted Saturday after a court handed down death sentences to almost two dozen local fans involved in a deadly melee at a Port Said soccer game last year. Immediately after the ruling was announced, angry residents and young men went on a rampage in the city, attacking the prison where the defendants were being held and trying to storm police stations and government offices.

The street clashes in Port Said were the latest in a bout of unrest that has left a total of 42 people dead in two days, including 11 killed in clashes between police and protesters marking Friday's second anniversary of the uprising that overthrew longtime leader Hosni Mubarak. On Sunday, clashes continued for the fourth successive between protesters and police near Cairo's central Tahrir square, birthplace of the 2011 uprising. Police used tear gas, while the protesters pelted them with rocks.

The bloodshed highlights the challenges facing President Mohammed Morsi, who took office nearly seven months ago following the uprising that ousted Mubarak. Critics say Morsi has failed to carry out promised reforms in the country's judiciary and police force, and claim little has improved in the two years after the uprising against Mubarak.

As the situation spiraled out of control Saturday, police disappeared from Port Said's streets, residents and security officials said.

The military then dispatched troops to the city, which is located on the northern tip of the Suez Canal. Soldiers took up positions at vital state facilities, including the local power and water stations, the city's main courthouse, the local government building and the city prison. Navy sailors were guarding the local offices of the Suez Canal company.

Navy vessels were escorting merchant ships sailing through the international waterway, and army helicopters were flying over the canal to ensure the safety of shipping, according to Suez Canal spokesman Tareq Hassanein.

Residents said Port Said was quiet overnight except for the intermittent bursts of gunfire. The city was still on edge Sunday, although a degree of calm had returned. Streets were largely deserted, stores were closed for the second successive day, and some hotels asked guests to leave, fearing more violence.

Funerals for those killed on Saturday were to be held later Sunday, and residents said they expected more street clashes after the city buries its dead.

The officials and residents spoke on condition of anonymity because they were not authorized to speak to the media.

Saturday's riot in Port Said mostly stemmed from animosity between police and die-hard soccer fans know as Ultras, who also were part of the uprising that toppled Mubarak's regime.

The Ultras were at the forefront of protests against the military generals who took over from Mubarak and are now again on the frontlines of protests against the rule of Islamist President Mohammed Morsi.

Survivors and witnesses of the Feb. 1 soccer melee in Port Said say Mubarak loyalists had a hand in instigating the killings, which began after Port Said's home team Al-Masry beat Cairo's Al-Ahly 3-1. Some say "hired thugs" wearing green T-shirts posing as Al-Masry fans led the attacks.

Others say, at the very least, police were responsible for gross negligence in the soccer violence, which killed 74 people, most of them Al-Ahly fans.

Anger at police was evident in Port Said, home to most of the 73 men accused of involvement in the bloodshed, although the trial was held outside Cairo.

Judge Sobhi Abdel-Maguid did not give his reasoning when he handed down the sentences for 21 defendants on Saturday. Executions in Egypt are usually carried out by hanging.

Verdicts for the remaining 52 defendants, including nine security officials, are scheduled to be delivered March 9. Some have been charged with murder and others with assisting the attackers. All the defendants ? who were not present in the courtroom Saturday for security reasons ? can appeal the verdict.

2 rescued after small plane crash on Hudson River

YONKERS, N.Y. (AP) ? Two people were rescued Sunday when their single-engine plane crashed and sank into the icy Hudson River off Yonkers, authorities said.

The small plane was carrying a man and a woman on a sightseeing trip, and crashed about 5:20 p.m., Yonkers Police Lt. Phil Collins said. The two were wearing life vests and were able to get out of the plane before it sank, Collins said.

The cause of the crash was under investigation.

The couple were plucked from the waters within 30 minutes of the crash and taken to Jacobi Medical Center. They were treated for hypothermia and were listed in stable condition at Jacobi, Lt. Toni Scherer of Empress Ambulance Service said. The names of the two were not immediately released.

Federal Aviation Administration spokeswoman Kathleen Bergen described the plane as a Piper PA-32. Bergen said the pilot told local authorities the flight left from the Trenton-Robbinsville Airport in Robbinsville, N.J. It was flying under visual flight rules and not receiving air traffic control services, she said.

The Journal News reported that Yonkers police officers and a retired detective took a boat out to rescue the two.

"Thank God we got there quick enough," said Daniel Higgins Sr., an off-duty police officer who piloted the boat.

In 2009, Capt. Chesley "Sully" Sullenberger safely landed US Airways Flight 1549 on the Hudson River in New York after striking a flock of geese. All 155 people aboard survived.

Mazda hopes ride a tankful of chicken guts, beef tallow and pork lard to victory at the grueling Rolex 24 endurance race in Daytona over the coming weekend.

No, the maker isn?t sponsored by the local butcher.? It?s powering its new Mazda6 race car with a custom-made fuel blend that starts out with scraps from Tyson Foods. That organic glop has been converted into a special bio-fuel that will stoke the new SkyActiv-D clean diesel engine that will power Mazda?s entry into the new Grand-Am GX Class at the 24-hour race.

?It?s meat packing residue,? explains John Doonan, the director of Mazda?s ambitious motorsports operation.? And the ultimate blend is so clean the Mazda6 race car won?t need particulate filters or any of the other devices used on other diesel-powered race cars.?

Indeed, Mazda is not the only manufacturer that has switched from gasoline or ethanol to diesel power on the track.? Audi has dominated the Le Mans endurance circuit for much of the past decade, in fact, with a series of racers that routinely leave the competition struggling to keep up.??

That?s helped put the spotlight on the German manufacturers focus on the diesel technology it?s putting on the street.? At the Los Angeles Auto Show last November, the maker announced it would soon add four new diesel models to its U.S. line-up.

European car buyers are well aware of diesel?s advantages ? it delivers near hybrid levels of fuel economy and far more power than gas-electric powertrains. Americans, however, are just beginning to catch on. So, it?s Mazda that now needs to get the message across as it prepares to introduce its own new diesel engine to the U.S. market.

In fact, the engine that will be powering the Mazda6 on the Daytona track started out as one of the first production diesels the maker assembled back in Japan last year.??

The new Mazda6 SkyActiv-D racecar will have some big tire tracks to fill, replacing the maker?s successful RX-8 model.? Mazda will also field two new teams starting with the 2013 Rolex 24 Hours of Daytona.? It will lose its two previous teams, including Dempsey Racing, which was owned by actor and motorsports fanatic Patrick Dempsey.The maker gave its racing team a mandate, explains Doonan, ?to use as many production components as possible. The only things we?ve changed are the crankshaft, pistons and connecting rod.?? And with good reason considering the track-tuned SkyActiv-D will be churning out 400 horsepower and 450 lb-ft of torque, about double what a street-legal 2014 diesel-powered Mazda6 will be making when it goes on sale later this year.

It?s a risky move to launch a new car with new teams and drivers but Mazda is hoping it will pay off and put the brand in the spotlight this year.

The maker has been going through plenty of changes everywhere you look.? It has largely wound down a decades-old relationship with Ford Motor Co. and stopped producing the Mazda6 at a plant the two makers jointly operated in suburban Detroit.

Mazda, meanwhile, has established several new ? if more limited ? alliances with Toyota and Fiat.? The Italian maker?s Alfa Romeo division plans to work with Mazda to develop a new sports car that both companies can sell.? Ford Mazda, it will serve as the replacement for its aging Miata 2-seater. Toyota, meanwhile, will base a replacement for its subcompact Yaris off the Mazda3 platform. And Mazda will produce some of the new models for Toyota out of a plant it is currently setting up in Mexico.?

More alliances could follow, according to Mazda CEO Takashi Yamanouchi.? That could help the small Japanese automaker reduce the hefty expense of developing new products.? Not that Mazda is waiting for assistance.? It has been rolling out an assortment of new models, such as the well-reviewed CX-5 crossover.?

It has also introduced a new concept, dubbed SkyActiv, that it claims can compete with the efficiency of rivals? hybrid products. At its heart, SkyActiv is a new approach to powertrain technology but it also entails steps Mazda engineers are taking to improve the overall efficiency of the maker?s vehicles, down to finding ways to reduce the weight of the lugnuts on the wheels of the new Mazda6.

The all-new version of the sedan will be offered with both the new SkyActiv gasoline and diesel powertrains.

Unfortunately for those who might opt for the SkyActiv-D, they?ll likely have a hard time finding the synthetic diesel Mazda will use on the race track. The renewable blend was developed by Dynamic Fuels, a 50/50 joint venture of Tyson Foods and Syntroleum, and it is being produced at a $150 million refinery which opened up near Baton Rouge, Louisiana two years ago.?

Why Tyson? Because the maker has had to find ways to dispose of 1.5 million pounds of chicken, pork and beef products every single day. Now it can avoid the cost of dumping that offal and potential make some money from it.? The refinery is producing about 75 million gallons of synthetic diesel annually and could ramp up to provide even more.

A number of refiners are working to come up with bio-fuels. The most readily available are ethanol blends. They?ve been controversial because, until now, most have used food stocks, such as corn ? though newer, so-called cellulosic production methods can create the alcohol fuel from waste.?

Many of the new bio-diesel blends use waste products ? though a select number of filling stations near San Francisco recently began offering a blend created from algae.

Dynamic Fuels ultimately hopes to begin selling some of its synthetic diesel to the public and is shooting for a $5 a gallon price tag, notes Mazda?s U.S. CEO Jim O?Sullivan.

Some shuttle buses operated by Alamo and National Car Rental are already testing it on the street. And the U.S. Navy is also using the bio-diesel blend on some of its ships.

Those who buy the new Mazda6 with SkyActiv-D will have to settle for conventional, petroleum-based diesel fuel. But the maker is hoping that with a 14.5 gallon tank of distilled guts under its hood, the Mazda6 race car will dominate its field when the flag drops at Daytona on Saturday.

Internet necessity: German court says being online 'essential' ? RT

The internet has now become an officially 'essential' thing people cannot do without, just like the phones or television, according to a court ruling in Germany.

?"Most people in Germany use the internet daily. Thus it has become an essential medium in the life of the society, the disruption of which has an immediately impact on the course of everyday life," the Federal Court of Justice in Karlsruhe states.

Now a German telecommunications company will have to pay a client compensation for failing to provide its services.

The Karlsruhe court made this decision after hearing the case of a man who was erroneously disconnected from his DSL line for two months in late 2008-early 2009. Initially, the provider also offered a telephone and fax line which also failed their customer.

The plaintiff has already received compensation for having to use his mobile device, but sought damages for not being able to use the internet and other services.

"Due to easy access to information, the internet has overtaken the role of mass media such as encyclopedias, print press and TV. It allows global exchange between the users, such as through the email, forums, blogs and social media. Besides, it is becoming more and more crucial for negotiating and striking deals as well as fulfillment of public service obligations," the court ruling reads.

Now that the internet has made it to the list of essentials, German law states that the loss of its use can be liable for compensation.

The damages the plaintiff initially wanted amounted to 50 euro per day for the period he was unable to use his DSL, fax over IP and VoIP services. However, the court only awarded compensation for the loss of the internet connection, saying fax usage is limited and ?irrelevant? when compared with emails, and the VoIP phone inessential since the plaintiff had a mobile phone.

The final amount of compensation is yet to be determined.

To properly celebrate, let's relieve history a bit by traveling along with photographer/videographer Joe Corrigan as he remembers his Concorde flights, roundtrip JFK-LHR in July 2003 on the British Airways supersonic birds G-BOAC and G-BOAF:

I don't know quite what it was about Concorde, but ever since I first saw her as a kid, I was mesmerised. That shape, those lines?there was something about her that drew me in. I was 14 the first time I saw her with my own eyes, as my my uncle had discovered Concorde would fly into Sydney, my home town, on a round-the-world charter. Together we headed to the airport to see her land.

That aircraft, F-BVFC, zoomed in and landed with full reverse and later took off with full afterburner as I watched from afar. I was hooked. The experience was not only visual and aural, but earth-shaking. Everything in the vicinity shuddered under the engine power; you could feel Concorde slice through the air and this in itself made it all the more visceral. It became a dream of mine to fly on her, one I never thought likely to come true.

The stars aligned for me when I was 18. Working with a very knowledgeable travel agent, I was afforded the amazing opportunity to join the very exclusive club not just once, but twice. This club was one of supersonic travelers, people who have flown faster than a rifle bullet and viewed the curvature of the earth.

As far as first impressions go, this was like nothing I had experienced before or have since. Check in was in a separate hall at Heathrow Terminal 4 and although I'm not normally one for checking a bag, how could I resist a bag tag from Concorde? From there it was through the Fast Track at Heathrow T4 and into the Concorde Room. Here was the start of the truly elite experience as the Concorde Room was unparalleled in service and amenities. Among other niceties, I enjoyed canap?s, vintage champagne, and an a-la-carte menu for something more substantial, all served on Royal Doulton bone china.

Finally the boarding announcement shook me from my reverie as it was time to start the main event. Onboard I was first struck by the navy blue leather seats with stainless steel trim and lavender and cream blankets. The cabin was cozy and, though a little light on head room, amazingly spacious once seated. I had a bulkhead seat?front row for the flight, of course.

Terence Conran, along with British Airways, did a marvelous job with regards to the customer experience, and the attention to detail in the fit-out was something else. Each seat sported a speedmarque embossed into the leather as well as engraved into the polished seat belt buckle. The underside of the tray table was upholstered in the same soft navy leather, the armrest swiveled 90 degrees when stowed so as to slip unobtrusively between the seats, and the whole seat reclined as one unit so that it cradled you and supported your thighs whilst reclined. Little things on the face of it, but they make a huge difference.

Safely airborne we steadily accelerated to Mach 1 and a cheer went up in cabin since a display ticked away the number for all to see. Our sonic boom came over the ocean so as not to disturb people on the ground, and we continued toward Mach 2 on a climb to 55,000 feet. It was there, in our cruise, that the in flight service began in earnest. Three courses and an excellent wine, champagne and scotch selection all came served up on more fine Royal Doulton bone china. The flatware was designed, once more, by Terence Conran.

So did I appreciate all that was before me? Of course not! On reflection, I made the most of it at the time but I don?t remember the 1988 vintage champagne, or even what I had to eat. I do, however, remember the afterburners lighting two by two, pushing Concorde into the small of my back, as well as looking out the window and down to see a curved earth and then up to see the black abyss.

My only complaint is that it was all over so quickly. Three hours is only just long enough to have a three-course meal of that calibre, but at least I took some photos and enjoyed it all I could...twice.

Green Blog: Hurdles Remain for Jaguar Habitat

Last fall, remote cameras in a rugged expanse of desert grasslands in Southern Arizona captured arresting images of a jaguar slinking through the underbrush, its yellow eyes fixed on some distant sight. The photos add to the dozen or so documented sightings of the endangered cat on American soil in the last century.

The monitoring project, conducted by the University of Arizona in conjunction with the federal Fish and Wildlife Service, is providing data that will inform decisions about a proposed critical habitat for the big cat: 838,000 acres in Southern Arizona and New Mexico, an area roughly the size of Rhode Island.

Many have hailed the proposal as a landmark victory for the jaguar, which has been on the Endangered Species List since 1997.? But there are hurdles to clear, not the least of which is a plan for an open-pit copper mine that would be smack in the middle of the jaguar?s territory.

The mine?s potential impact on the jaguar is being studied by the Fish and Wildlife Service and the Forest Service, which manages the land designated for the jaguars in the Coronado National Forest.

The two agencies must decide, working with the mining company, what restrictions or changes they will require for the mine project with the goal of protecting the jaguar and the other federally listed species in the area. An opinion from the wildlife service was due by Dec. 20, but because of changes in the mining plan, that deadline has been put off.

Officials say they expect the opinion to be released within the next several weeks.

When the proposal was announced in August, many hailed it as a landmark victory for the jaguar. Conservationists have been fighting to have land set aside for the animal for years. The Center for Biological Diversity has repeatedly sued the Fish and Wildlife Service, the agency that administers the Endangered Species Act, to force the agency to designate a habitat and formulate a recovery plan for the jaguar.

?That area is key for jaguar recovery,? said Randy Serraglio of the Center for Biological Diversity. ?If we follow the law, as laid out under the Endangered Species Act, they will come back. They always lived there, until the U.S. government either killed them or chased them out.

The proposed critical habitat for the jaguar is one of the most biologically diverse in the country and is home to 10 endangered species.

Mr. Serraglio argues that the photos of the jaguar should be ?the nail in the coffin of Rosemont Mine,? adding, ?There?s no way the mine proposal can go forward if this land is designated as critical habitat.?

Jamie Sturgess, a vice president at Rosemont, has blasted the Center for Biological Diversity, saying that it uses ?bullying tactics? and ?has a history of gaining millions of our federal tax dollars through intimidation and litigation.?

Tony Povilitis, a wildlife biologist, says the Fish and Wildlife proposal does not give jaguars enough space to roam and hunt and fails to link important ?jaguar corridors.? With continuing development in the Southwest, he said, the animal?s ?habitat is becoming fragmented. There?s still time to change that, but there?s not a lot of time.?

Complicating matters, the ?build it and they will come? approach to designating a geographic area containing the things a species needs to survive is controversial. Some wildlife officials and biologists argue that the jaguars are no longer living and breeding in the United States but just wandering in from south of the border. Fish and Wildlife officials said that the jaguar seen in all 10 photos ?appears to be the same individual.?

Alan Rabinowitz, an expert on big cats, has written that because jaguars do not clearly occupy any territory in the United States, the environment there is seemingly less than ideal for them.

The public comment period for the Fish and Wildlife Service?s critical habitat proposal published in August will? reopen this spring. A final critical habitat determination is expected by August.

Meanwhile, the monitoring by camera continues. The photos ?offer little, teeny clues that help us to pull together a picture of what the jaguars are doing there,? said Jeff Humphrey, a spokesman for the Fish and Wildlife Service. ?Are they eating? Are they hunting? Are they just passing through? There are a lot of questions ? they?re very enigmatic animals.?

Mickelson likely pays less taxes than he thinks

Fresh off the course at the Humana Challenge golf tournament this weekend, Phil Mickelson told reporters that recent tax hikes on the rich might force him to make "drastic changes," suggesting he'd be leaving either golf or his home in California.

At the center of Mickelson's tax complaint was his claim that he pays a tax rate of 62 to 63 percent.

"If you add up all the federal and you look at the disability and the unemployment and the Social Security and the state, my tax rate's 62, 63 percent," Mickelson said. "So I've got to make some decisions on what I'm going to do."

There is no doubt that Mickelson's taxes are high. And they just went up by an additional 7.9 percent over the past three months due to the "fiscal cliff" deal and California's Proposition 30.

But several accountants interviewed said it's unlikely that Mickelson is actually paying a rate above 60 percent. With even the most basic tax planning, they said, his real rate is most likely closer to 50 percent.

After his comments turned into a rare off-course controversy for Mickelson, he apologized but didn't back away from his numbers. "Finances and taxes are a personal matter and I should not have made my opinions on them public," he said today in a statement. "I apologize to those I have upset or insulted and assure you I intend to not let it happen again."

But let's consider those numbers.

Under current tax rates, Mickelson would pay 13.3 percent in state income tax and 39.6 percent in federal income tax. That's 52.9 percent combined. Medicare and Medicaid is an additional 2 percent. The new health-care levy is .9 percent on earned income and 3.8 percent on investment income.

Self-employment taxes could total an additional 15.3 percent -- but that's only on income up to $113,000, accountants say. After that the rate is 2.9 percent.

Mickelson would also pay local taxes where he plays tournaments. That could add another one percent or two percent.

So the maximum Mickelson could pay in state and income taxes, payroll and other income-related taxes would be around 60 percent.

But that rate is only if he did absolutely no tax planning or basic deductions. He would, for instance, get a deduction on his state income taxes from his federal. He would also deduct any golf-related expenses as a business expense. He probably puts money in a retirement plan, which is tax-favorable.

I would guess that Mickelson has some investments, which would be taxed at the lower capital gains rate of 20 percent (or 23.8 percent with the new health-care tax). And I would guess he might have a mortgage deduction, or other deductions related to kids and education.

And we know that Mickelson gives money to charity. So that would be deducted as well. If he has trusts (which he likely does) that also reduces his tax rate.

Steven Piascik, president of Piascik ? the accounting firm that works with dozens of professional athletes ? said that he easily could bring Mickelson's rate to around 50 to 52 percent with some "basic tax planning."

"I couldn't guarantee it, but 8 to 10 percent off that 62 percent rate seems normal," he said. "I would guess he's doing a lot of these things already."

Either Mickelson misspoke ? or he needs to hire a new accountant.

Alt Summit Dining Guide | SLC Foodie

For all of those lovely, creative folks coming into Salt Lake City for Alt Summit this week, I put together a little dining guide for you.

First I want to tell you just a bit about our dining and drinking scene. ?There are a lot of misconceptions about food and drink in Utah. ?First of all, you can get a good drink in Utah, perhaps even a drink you?ll be thinking about when you return to your home state. ?Secondly, our emerging food scene is especially note worthy, as we have a growing number of passionate food enthusiasts starting small businesses and restaurants, from European style marmalades, to the finest old world Salami, and modern tapas restaurants. I think you?re going to love the food and drinks here in Utah!
